| Article 85-Vacancy of Office | ||
| 85.1 | Vacancy of Office | |
| An office may be declared vacant upon the death or resignation of the Official, or upon the expulsion of the Official. | ||
| It shall be the responsibility of the appropriate elected body to declare the office of an Official open and to call for nominations for the position. | ||
| 85.2 | Filling of a vacant office | |
| The instrument for declaring an office vacant shall be a Writ issued by the appropriate elected body to which the office belongs within thirty (30) days of the office being vacated. | ||
| Providing an election for such office is not due within ninety (90) days from the date of vacancy, the right of appointing a person to office shall rest with a vote of the total members of that body, or if in recess to the majority leaders of that body subject to their proper eligibility to such office. | ||
